MANZINI – A man has related how his wife allegedly showed disrespect by telling him that she was being sexually satisfied by another man.

Simon Maziya, who is contesting a divorce from Hlobisile Maziya (nee Dlamini), further alleged that while he tolerated everything and condoned same, his wife then started indulging in alcohol something which he doesn’t do. He is represented by Thabiso Fakudze of Fakudze Attorneys. They were married on August 24, 2002, by civil rites and in community of property. Two children were born from the marriage.

Simon in his responding papers challenging the divorce proceedings initiated by Hlobisile alleged that he at some point caught his wife red-handed with a police officer based at the Mafutseni Police Station in November.

He claimed that Hlobisile and the man were in a relationship and on the above date, the cop was driving his wife’s car and he chased after them. He eventually caught up with them at Coates Valley, Manzini, due to the fact that they had driven to a dead end.

Simon said he then fought with the officer and the matter was even widely reported in the Times of Swaziland in November last year.

He also contests that he did not threaten Hlobisile nor had he assaulted her. Simon said he has never had any criminal charges laid against him by his wife and he has never committed any unlawful conduct against her.

He denies ever making death threats or verbally insulting her either in full view of their children or anyone else for that matter. Instead, he claims that he forgave his wife for what she had done.

Simon alleged that his wife was proceeding with the divorce because she is allegedly being pushed to do so by her boyfriend.

He claims Hlobisile left their matrimonial home in December last year for about two weeks and he didn’t know where she was staying. He alleged that Hlobisile only returned home after his family had engaged her in talks. Simon said instead of Hlobisile filing for divorce, it should actually be the other way round but he does intend to pursue an order for judicial separation and or a divorce because he had forgiven her for the sake of their minor children. Moreover, he said Hlobisile is human thus she is bound to make mistakes.

 

He said Hlobisile is not entitled to the order of a judicial separation and the issue of custody of the children therefore does not arise. The matter is still pending in court.

Why Hlobisile wants a divorce

 

 Manzini – Estranged wife, Hlobisile Maziya (nee Dlamini) wants a divorce from Simon because he had allegedly committed wrongful and unlawful acts such as emotionally and verbally abusing her.

She alleges that he did this by hurling insults and accusations of matrimonial infidelity against her.

Simon is also alleged to have physically assaulted Hlobisile and strangled her in full view of their minor children and neighbours such that the children are scared of him.

Hlobisile further alleged that Simon also verbally abused relatives and her friends for no reason and threatened her with assault or death on a continuous basis. She, as a result ended up reporting Simon to the Manzini police for assault and threats.

"The defendant continues to assault, verbally insult, abuse and traumatise the plaintiff therefore the plaintiff requires an Order for Judicial Separation, she further requires that she vacates the matrimonial home to stay away from the defendant for her own safety and take away all her personal belongings," the papers read.

She also wants custody of the children to ensure their safety as they are scared of the defendant.

Hlobisile further wants Simon to pay a monthly maintenance sum of E2 000 as shall be determined by the court at trial for the upkeep of the family for the duration of the separation. Hlobisile is represented by SS Mnisi Attorneys-Piliso Simelane and Partners
