GELANE WINS ORDER STOPPING HARASSMENT, INSULTS

MBABANE - Acting Chief of  KoNtshingila Gelane Simelane has obtained an interim order stopping the members of this community from causing unrest in the area.


This comes after she moved an urgent application at the High Court yesterday through the office of the Attorney General.
Respondents in this matter are King Simelane, Jerome Simelane, Innocent Mciniseli Simelane, Ntokozo Mhlongo, Nhlanhla Simelane, Menzi Masoka, Mbongeni Simelane, Juliouse Bhembe, National Commissioner of Police and any other person who incites or involved in the violence that occurred at KoNtshingila.


Appearing for the acting Chief were Senior Crown Counsel Vusi Kunene and Crown Counsel Nonophile Mavuso from the chambers of the Attorney Gene-ral.
The court also interdicted the respondents or any other person who acts in conjunction with them either through their ins-tructions to incite violence against her to stop from doing so.


“The respondents or any other person who acts inconjuction with the respondents and or on their volition are interdicted and restrained  from harassing the applicant (Gelane) either by threatening violence against the her or insulting her,” reads parts of the order.
They were also interdicted and restrained from causing violence in whatever manner at KoNts-hingila Chiefdom or Umphakatsi and the surrounding areas.


The National Commissioner of Police was also ordered to take all necessary steps to ensure that peace is maintained in this area.
The court also ordered that the interim order be announced in national media.
The interim order was issued by High Court Judge Mumcy Dla-mini yesterday.


In her application the acting Chief alleged that one of the respondents Jerome Simelane was one of the elders who incited or perpetrates violence against her or at KoNtshingila Umpha-katsi (kagwegwe)
She further alleged that another respondent Innocent Mciniseli Simelane who is a teacher at Salesian High School was also the one who incited and perpetrated violence against her and the Umphakatsi.


In her founding affidavit she accused the 10 respondents as being the ones behind the violence in the area.
The matter returns to court on November 8, 2013 and the respondents are yet to file their papers.
