FIRED TEACHER SUING GOVT E130 000

MBABANE – The Nkhaba High School teacher who was dismissed after being found guilty of wrongfully awarding SGCE Design Technology pupils full marks for evaluation of their project, is suing government a sum of E130 000 for unfair dismissal.


Phumelele Nkhomo of Ludzeludze was dismissed last year after the Teaching Service Commission (TSC) found him guilty on four counts of contravening the Teaching Service Regulations of 1983.


According to the TSC charge sheet, in 2015, Nkhomo wrongfully awarded the pupils full marks, 30 and 10, testing and evaluation of the project, respectively.


The head teacher of the school testified that Nkhomo awarded these marks despite that the pupils had not undertaken the practicals, which was a serious malpractice.


The TSC heard that Nkhomo was asked if it was correct to award a mark when no marking had taken place and no project undertaken at all. His response was that it was wrong to do so and added that putting a dash instead would have been better.  The head teacher said Nkhomo failed to give a satisfactory answer when asked why he did not put a dash if there was no mark to record.


The pupils, according to the TSC judgment, were all disqualified by the Exams Council due to the conduct of the teacher.  Nkhomo was also accused of not teaching other classes except for Form I. This was said to have been uncovered by the regional inspector of Design and Technology.


The TSC judgment further showed that Nkhomo failed to submit the underlisted official books to the regional inspector despite reminders from the head teacher. The TSC found him guilty on all four counts and dismissed him. Nkhomo reported a dispute with the Conciliation Mediation and Arbitration Commission (CMAC) which issued a certificate of unresolved dispute.
