EEC SUED FOR E3.6 MILLION

MBABANE  – Eswatini Electricity Company (EEC) is being sued for over E3.6 million by Patco (PTY) Limited.


Patco (PTY) is a limited liability company duly incorporated and registered in terms of the Companies Act and carrying business in Ezulwini.
The plaintiff (Patco) has since instituted legal proceedings against EEC where it is demanding payment of E3 660 187.70.


The aforementioned amount according to Patco (PTY) Limited was in respect of goods it allegedly sold and delivered to EEC at the latter’s special instance and request.


According to the plaintiff, despite written demand, the defendant (EEC) allegedly failed and/or neglected or refused to pay.
These are allegation contained in the simple summons whose veracity is still to be tested


In its simple summons, the plaintiff is further seeking an order that the defendant be ordered to pay the money with interest of nine per cent per annum calculated from the date of the summons to final payment.


EEC has filed its notice to oppose the application.  In the simple summons, the electricity company was informed that if it disputed the claim and wished to defend the action, it should within 10 days of service of the summons, file with the registrar of the High Court, and serve the plaintiff’s attorneys with a notice of intention to defend and other defending papers.


“Inform the defendants that if it fails to file and serve notice as aforesaid, judgment may be given against it without further notice,” reads part of the summons filed by Patco (PTY) Limited.
The matter is still pending at the High Court.
