NO JUDGMENT IN MNZ WANDERERS COURT CAS
MBABANE – The judgment in the Manzini Wanderers court case, where they seek an order directing the chief immigration officer to testify in their relegation matter, is expected today.
The matter was before High Court Judge Bonginkhosi Magagula after the hub giants sought the court’s intervention in their relegation case against Denver Sundowns.The matter is expected to be heard for the fifth time by the Eswatini Football Association (EFA) Disciplinary Committee (DC), this evening at Sigwaca House. The ‘Weslians’ representative, in Lawyer Sifiso ‘Charlie’ Jele, revealed the reason behind seeking the court’s assistance which he said was due to the fact that the EFA DC chairperson did not have the powers to force a government officer to appear before it.
“The only institution that can do that is this court as we even requested the EFA to help us, but up to now, we haven’t received a response. The public needs to find closure in this case. We urge the court to grant us our prayer,” Jele said. Lawyer Osborne Nzima, who was representing the implicated players urged that the matter was not of urgency as the applicants should have approached the court after exhausting all the structures needed to address the case. He said the matter was still pending before the EFA DC. “Since the matter is pending and to be heard tomorrow, as it stands there is no decision the DC has taken. If the court entertains this it would be like they are taking the matter away from the EFA DC tribunal,” Nzima said.
Judge Magagula, after hearing the parties’ submissions and being informed that the matter would be before the EFA DC at 5:30pm today, postponed the matter.“The court will need time to check on the submission, so the case is postponed to tomorrow at 2:30pm,” Magagula announced.It is worth mentioning that even the Premier League of Eswatini (PLE) Chief Executive Officer (CEO) Kenneth Makhanya was also present to hear the case.
