MBABANE – Former Mbabane Swallows forward William Kunene is demanding E125 000 from Mbabane Swallows.

The aforementioned amount, according to Kunene, is in respect of alleged breach of contract and unfair dismissal by the club. He contended that the decision by the club to allegedly unilaterally terminate his contract was tantamount to unfairly dismissing him.

He wants E65 000 for the alleged breach of contract and E60 000 for the purported unfair dismissal.

Kunene had a two-year contract with Swallows that was due to expire in June next year but it was terminated in June 2020 with 14 months remaining.

Kunene had since taken the team to the Conciliation Mediation and Arbitration Commission (CMAC) where he is demanding the said amount.

“On June 1, 2019, the applicant (William Kunene) and respondent (Mbabane Swallows) entered into a three-year contract agreement and both parties complied with the terms of the contract until June 23, 2020 wherein the respondent acting in breach of contract, terminated the applicant’s contract of employment. The contract of employment was left with a period of 14 months when the respondent terminated same,” reads the report of dispute.

allegations

These are allegations whose veracity is still to be tested and the club is yet to present its side of the story before CMAC.

Kunene argued that there were no reasons advanced for termination. He was earning a basic salary of E5 000 while his signing on fee was E20 000 when he signed the new contract with the Birds last year in June.

Kunene is represented by Sifiso Jele of SM Jele Attorneys and they had since written a letter of demand to Mbabane Swallows who are yet to respond.

Kunene is seeking a reinstatement, alternatively, compensation for breach of contract, E5 000 X 13 months that total to E65 000 and compensation for unfair dismissal that is E5 000 X 12 month and it equals to E60 000.
