AAS TAKES INTERIM COMMITTEE TO COURT

MBABANE - All is not well at the Athletics Association of Swaziland (AAS). The association, which is chaired by Gideon Mthembu, has taken the five members of its interim committee to court for allegedly being in office illegally.

The five members are set to appear this morning at the Mbabane Magistrate’s Court. The first applicant in the matter is the AAS, with President Gideon Mthembu being the second and Sipho Vilakati, who holds the position of Chairman of road and cross country portfolio, is the third applicant.

The five respondents are the AAS Secretary General Thoba Mazibuko, TZD Athletics Club Director Zakhele Dlamini, Manzini Athletics Club (MAC) Coach Muzi Mabuza, Harry Malindzisa and Deli Simelane. They are all part of the interim committee.

The applicants want the court to stop the respondents from proceeding with a meeting scheduled for this Saturday or any other meeting thereof. In an affidavit that has been filed by Mthembu, the applicants, through their lawyer Bongani Phakathi of M.H. Mdluli Attorneys, also seek an order interdicting the five members from operating and or presenting themselves as the leadership of the association. They are further praying for an order directing them to hand over all assets of the association to the Board or Executive Committee.


Mthembu narrated that he was constitutionally elected the president of the association in January 2017 during a General Assembly. He alleged that he was elected to serve for a period of four years, according to the constitution.

“On December 1, 2018, there was an annual General Meeting held at the technical Centre in Lobamba, wherein the members of the association were accordingly represented.
“Unfortunately, the meeting became hostile and some of the members ended up abandoning the meeting. After much deliberations, I decided to exercise my powers as per the constitution of the association and ended the meeting with the hope of rescheduling same.
