JUDGE RECUSES HIMSELF

MBABANE – “I recuse myself because of my personal relationship with some of the leaders of the club”


This was said by High Court Judge Titus Mlangeni when he recuses himself from the matter between Manzini Wanderers and Swaziland Posts and Telecommunications Corporation (SPTC).


The matter was due to be heard on Friday and the lawyers had already filed the necessary papers in readiness to argue it when the judge announced that he was recusing himself.


The recusal of Judge Mlangeni from this matter now means that the Registrar of the High Court will have to find another judge to hear it.
 The 2016 Swazi Telecom Charity Cup runners-up alleged that they were being owed E200 000 of their prize by SPTC.


According to the team, their prize money was allegedly deducted by the sponsor of the tournament without its consent.
The team has since instructed Mbabane senior lawyer Mandla Mkhwanazi to institute legal proceedings against the company seeking an order directing SPTC to pay the money.


The Premier League of Swaziland (PLS) has also been cited as a second defendant in the matter.
In the application for judgment by default it has been stated, ‘take note that the application will be made to the above honourable court (High Court) on November 21, 2016 at 9am or soon thereafter as the matter may be heard for the judgment against the first defendant as claimed in the summons.’


“Summons have been served on the first defendant, who failed to deliver its plea for the payment of the total sum of E200 000 being in respect of monies owed by the first defendant to the plaintiff,” read the summons.
