COURT STOPS ‘CHAKA CHAKA’S DISMISSAL
MBABANE – For the second time running, National First Division League outfit Matsapha United have failed to fire their head coach, Matthews ‘Chaka Chaka’ Mandlazi.
A decision was taken on Wednesday to expel the coach from the club after there was a disciplinary hearing chaired by one Sandile Ngwenya.
However, the Industrial Court ruled yesterday that the club could not dismiss Mandlazi and further ruled the DC proceedings be started afresh with a new chairman as opposed to Ngwenya, who is the second respondent in the latest urgent application made yesterday.
Represented by Thabo Hlanze of Gigi A Reid Attorneys, the coach had sought the court to set aside Ngwenya’s recommendation for termination of his contract with effect from the same Wednesday of February 8 and that the first respondent (Matsapha United) be deemed in contempt of court by failing or refusing to abide by the order issued the court on January 31, 2017.
He also wanted his employment contract’s termination declared irregular and ultra vires (in breach) the Employment Act, 1980, removing chairperson in ongoing DC, first respondent appoints new chairperson, DC starts de novo (afresh) and costs of application be taken by respondents.
The Industrial Court, through Judge Nkosinathi Nkonyane, ruled in his favour in all the prayers he had sought – marking yet another failed attempt by the club to part ways with their coach who they accused of bringing a woman to his allocated house at the club’s village on the eve of a match they went on to lose.
Mandlazi won his second interdict against the club as he was recently able to have his initial DC date put on hold by the court and also had his suspension without pay ruled illegal, which means currently he will still get paid until the DC is in accordance with the court’s ruling for a neutral and fair chairperson.
