Arrest warrant out for aspiring Timphisini MP

MBABANE – The court has issued an order for the arrest of Timphisini constituency aspiring MP Mbongiseni Menzi Mhlanga.


This comes after Standard Bank Swaziland LTD – Vehicle and Asset filed an application for the arrest of Mhlanga.
He was nominated over the past weekend to contest for the position of a Member of Parliament (mp) under Timphisini Constituency in the northern Hhohho.


A messenger of the court Bheki-themba Dlamini had since been ordered to seize and arrest Mhlanga. The messenger was also ordered to immediately bring him to court upon his arrest.
The court wants Mhlanga to show cause why he should not be committed to jail for days in contempt of an order that was granted on March 28, 2013.  The order was issued at the Siteki Magistrates Court. The members of the Royal Swaziland police had since been ordered to assist the messenger of the court in the execution of the order.


The aspiring MP is also expected to show cause why members of His Majesty’s Correctional Services should not be authorised to accept and keep him in their custody.
The application by the bank comes after Mhlanga allegedly refused to hand over a Ford Fiesta to a court messenger Bhekithemba Dlamini despite that there was court order compelling hm to do so.


In her affidavit Dumisile Mdluli who is the bank’s Rehabilitation and Recovery Manager stated that the court issued an order against Mhlanga to surrender or handover the motor vehicle to the Messenger of the court.
She alleged that on or about April 16, 2013 the Messenger Bhekithemba Dlamini served the order personally to Mhlanga.


Mdluli alleged that Mhlanga vehemently refused to handover or to return the vehicle to the messenger of the court. “He has deliberately hidden the said motor vehicle and refuses to disclose its whereabouts. The respondent’s (Mhla-nga) action of refusing to abide by the said order in the presence of members of the public and the police is contemptuous of the dignity and honour of this honourable court,” she stated.


She further alleged that Mhlanga had openly stated that he will not return the said motor vehicle to the bank and may dispose it in South Africa.
Mdluli submitted that the respondent was in willful contempt of the order granted by the court to seize and attach the vehicle.
The interim order is returnable on August 15, 2013.  Representing the bank is Thamie Lawrence Dlamini.

 

Former MP given until today to avoid arrest

MBABANE - Former Nkhaba Member of Parliament (MP) Enock Vusumuzi James Dlamini has been ordered to show cause why he should not be arrested.


This order comes after Dlamini who was nominated over the weekend allegedly failed to return a 2007 white Toyota Fortuner belonging to Standard Bank Limited- Vehicle and Asset Finance.


Dlamini was nominated by residents of Eluvinjelweni which is one of the constituencies under Nkhaba.
“You are herby summoned to appear before this court to be held at Mbabane on August 7, 2013  at 9pm or soon thereafter as the matter may be heard to show cause why a decree of civil imprisonment should not be made against you at the suit of Standard Bank Swaziland Limited – Vehicle and Asset Finance, in respect of inter alia non return of a certain motor vehicle a 2007 white Toyota Fortuner 3.0D 4x4 and payment of the amount of E10 139,” reads part of the order.


Last year the court issued an interim order that the messenger of the court should attach and seize the motor vehicle and that the agreement between the two parties was cancelled. The court also ordered albeit on interim basis that the bank should forfeit all amount paid.
The case returns to court today.
