Ex-High Court judge appointed Gambia CJ

MBABANE - Former Judge of the High Court of Swaziland Justice Mabel Yamoa Agyemeng has been appointed Chief Justice (CJ) of The Republic of Gambia.


Justice Agyemang, a Ghanaian, arrived in the country in September 2008. She handled landmark cases such as that of Free Primary Education, which had been brought to the High Court by the Swaziland National Ex-miners Association.


In a declaratory judgment, as opposed to a mandatory one, she ruled that government should abide by the country’s Constitution to provide free primary education although four years had elapsed since the adoption of the Constitution.


In Swaziland her contract expired on September 30, 2010. Agyemang is an expert Appeal Court judge from the Commonwealth Secretariat.
According to a Gambian newspaper The Point, Agyemeng’s appointment comes after the sacking of Justice Joseph Wowo five weeks ago after he was appointed as the new Chief Justice of The Republic of Gambia. The presidency announced that President Yahya Jammeh acting under the provisions of the Constitution of the Republic and in consultation with the Judicial Service Commission, decided to remove Justice Wowo from his appointment.


Agyemang was called to the Ghanaian Bar in 1987 and the Ghanaian Bench soon after, she has served in the judiciaries of the governments of Ghana, Gambia and Swaziland.


She began working for the Commonwealth Secretariat in 2004, first being sent to Gambia where she spent four years as a High Court judge, and then to Swaziland in a similar capacity.
She was appointed to the High Court of Swaziland in October 2008 for a two-year assignment to help strengthen the judiciary and deliver fast, expert judgments on cases.
