SPTC man wants E1m from soldier who slept with wife'
MBABANE – An employee of the Swaziland Posts and Telecommunications Corporation (SPTC), Albany Mdlovu, is suing a soldier for over E1 million.
The soldier allegedly committed adultery with Mdlovu’s ex-wife.
Mdlovu and his ex-wife, Hlobisile Sikhosana, were divorced on January 20, 2010. He claims that on various occasions in November 2009, he caught Sipho Lanford Dlamini and Sikhosana sleeping naked inside a car. Mdlovu claims that she admitted to having committed adultery with Dlamini.
Dlamini is said to be stationed at Nokwane Army Headquarters. He has filed a notice of intention to defend the lawsuit.
In his combined summons, Mdlovu claims that on November 11, 2009, he caught the two alleged lovebirds sleeping naked inside a Toyota double-cab with South African registration numbers. He claims he caught them twice in the vehicle, at first it was parked next to the Ministry of Public Works and, the second time, it was parked near the Transport Training Centre.
Mdlovu alleges that he again found the two, inside the same vehicle, parked at the Theatre Club car park, naked.
He alleges that he caught them on November 4 and 23, 2009 at the Bhunu Mall in Manzini and she admitted committing adultery with the soldier.
Mdlovu is demanding payment of E1 250 000.
He claims that he had been married to Sikhosana since February 7, 2003, through civil rites and in community of property. He also states that the marriage was dissolved in January by a divorce decree issued at the Mbabane Magistrates Court.
Mdlovu is represented by Sabelo Bhembe from Bhembe Attorneys, while Dlamini has appointed Magagula Attorneys.
Adultery
"As a result of the adultery, the plaintiff and his spouse’s company, Ludziwo Lwemaswati Business Consultants and Advertising Agents, was affected, forcing the closure of its two subsidiary companies, Ludziwo Foods and Phefumula Iafrica.
"This resulted in the machinery used in these subsidiary companies being dismantled and the offices closed," read Mdlovu’s summons.
He claims the companies, of which they were directors, were closed because they could no longer work together as a result of the alleged adultery.
He is claiming E450 000 for damages he incurred as a result of losing property he shared with his ex-wife.
Mdlovu is also demanding payment of E400 000 in respect of insult and embarrassment inflicted upon him and E350 000 for loss of comfort, society and loss of his spouse’s services.
He claims that notwithstanding demand; Dlamini has failed, neglected or refused to pay the amount. He also seeks an order to be paid interest of nine per cent per annum commencing on the date of judgment until final payment and costs of suit.
The matter is still pending before the High Court.
