MAN RESISTS ARREST, ASSAULTS SIX COPS

MBABANE - Six police officers have opened a case against a 48-year-old man of Queensgate, who they accused of assaulting them, while executing their duties at St Mark’s.

They are Sergeant P. Mbhamali, Constable J. Ginindza, Constable S. Dlulu, Constable Magagula, Constable Mkhonta and Constable Ngcamphalala. In their statement, which had been reduced to a charge sheet, the officers of the law alleged that Sibusiso assaulted them while resisting arrest. They stated that they effected the lawful arrest on Sibusiso after he had obstructed Mbhamali, Ginindza and Dlulu, while they tried to arrest him and confiscate alcohol. The booze was exhibits to  be used against Mxolisi Dlamini, who was accused of trading in alcohol without a licence. They mentioned in the charge sheet that Sibusiso shouted unpalatable words and further blocked their way while executing their duties.

Backup

The police officers stated that Sibusiso’s conduct resulted in them calling for backup. However, they submitted that Sibusiso continued to assault them while resisting arrest. Appearing at the Mbabane Magistrates Court, also charged for contravening Section 23 (1) (c) of the Criminal Procedure and Evidence Act of 1938 and resisting arrest, Sibusiso pleaded guilty to the charges. Mitigating on the sentence after conviction, Sibusiso acknowledged that he took a bad decision while under the influence of alcohol. He pleaded for the court’s leniency, stating that he had five children, who were attending school. He was sentenced to eight months imprisonment with an option to pay a fine of E1 000 in each of the counts. However, the sentences were made to run concurrently, meaning he parted with E1 000.

Meanwhile in the same court, Zandile Dlamini (35) of Mahwalala appeared charged with theft of a Samsung A04 cellphone valued at E3 000, the property in the lawful possession of Sandile Dlamini. Zandile pleaded guilty and pleaded for the court’s leniency. She was sentenced to eight months imprisonment with the option to pay a fine of E1 000.
