LAWYER ACCUSED OF THREATENING TO KILL WITNESS

MBABANE - “I am further advised that the applicant (lawyer) has started pointing fingers at some of his neighbours as being responsible for calling the police on him and that he is threatening to kill this witness.”   

Inspector Millicent Dlamini made these startling allegations in her affidavit, where she is vigorously opposing the bail application of the lawyer who is accused of raping and impregnating his children. “I wish to state that there is a high likelihood that the applicant will now evade his trial and flee to countries that have no extradition treaty with Eswatini. The evidence against the applicant is very compelling and highly likely to get a conviction,” she argued. She told the court that, in light of the available evidence, there was a high possibility that the applicant would be convicted. Inspector Dlamini said: “The higher the chances of conviction, the stiffer the sentence to be imposed, the greater the chances that the applicant will evade trial. She further pointed out that the applicant’s admission that on two occasions he was charged with similar crimes was proof that he could not keep or fulfill his bail conditions.

Abuse

The police officer said it was standard that one of the bail conditions was that he should not commit similar offences, but since the year 2008 to 2021, the applicant had allegedly knowingly and intentionally committed heinous acts of abuse against his own blood and relatives. “I submit that he cannot be trusted not to commit other offences once out on bail, especially to those who have to testify against him as he is well-known to them,” contended the police officer. Inspector Dlamini went on to state that the applicant had not been reporting at the police station for the offences he allegedly committed in 2008 and there was no other reason why he could not neglect them again. “The applicant has the propensity to commit similar offences and I truly believe that the abuse will continue if the court does not put a stop to it by denying the applicant bail,” she argued.

She informed the court that the playground was not levelled now as the evidence gathered was strong. She further disclosed that the children who were reportedly abused by the lawyer, were taken away from his homestead for their own protection and safety as the younger ones were aged between 13-15 years. “It will not, therefore, be in the interest of justice to release the applicant on bail now as we have reasonable apprehension that he will go on with his wicked ways and abuse more children.  His being released on bail would cement the notion that the applicant is untouchable,” contended the police officer.
