JUDGE MBUTFO FOR BAIL MATTER

MBABANE – The duty judge for this week is Judge Mbutfo Mamba, and he is expected to hear Mps Mduduzi Bacede Mabuza and Mthandeni Dube’s bail application.

By virtue of being the duty judge, as per procedure, all urgent applications filed this week fall on his lap, including the one filed by the two incarcerated Members of Parliament (MPs). The two MPs have filed their bail application under a certificate of urgency, which means that it will be heard by the duty judge for this week. It is also common practice at the High Court that matters that are brought under a certificate of urgency are heard by the judge who is on duty on that particular week. Judge Mamba started his judge duty on Friday afternoon and he is expected to hear all urgent matters that will be brought to the High Court this week, including that of the two legislators.

Opposed

The duo’s bail application, which is due to be heard on Friday, is being opposed by the Crown, which is yet to file its papers outlining why it is against the release of the pair. In their new bail application, MPs Mabuza and Dube have contended that there were new developments, which warranted their release from custody. Among the reasons advanced by the accused persons was that their continued incarceration had adverse effects on their businesses, which might lead to their closure and loss of jobs.
