MAGISTRATE ASSAULTED BY EX-CON

MANZINI - A senior magistrate, who had suspicions that an ex-convict had allegedly broken into his mother’s house, was severely assaulted with an iron rod (reinforce) on the head and further bitten in the knee by the same man.


The incident occurred on December 26, 2019 at the magistrate’s home situated at Ludzeludze.
The accused , who has been in and out of prison, Mvumeleni Nsibande (38) of Ludzeludze also allegedly vandalised the magistrate’s car, a sports utility vehicle (SUV) with the same iron rod.

The car was extensively damaged on the windscreen, driver’s door and also right mirror. The damages are valued at E5 000.
Statements submitted in court revealed that the Magistrate, Nhlanhla Joseph Dlamini, who is based at Nhlangano Magistrates Court, allegedly approached the accused after a family lunch held at his home.  This was after he had seen him allegedly coming out of his mother’s house carrying items suspected to have been stolen.

“I realised that he was not from my family and approached him. While I was trying to find out where he was from and what he was doing at my home, he vandalised the vehicle with the iron rod at the rooftop. I immediately opened the door and he fell and a fight ensued. He then assaulted me with the iron rod on the head and I bled profusely.

We continued fighting and I overpowered him and further took the weapon,” the magistrate’s recorded statements stated.
The magistrate stated that when the accused realised that the iron rod had been forcefully taken from him, he allegedly picked stones and damaged the car as he also used the same stones to damage the windscreen.


It was also gathered from the statements that magistrate Dlamini was also allegedly bitten on the knee by the accused when the incident occurred.
Magistrate Dlamini was with his children, who were inside the vehicle, when the assault incident occurred hence he tried his best to fight and overpower the accused.


Residents are said to have called the police after Nsibande allegedly left the rooftop of the vehicle and went underneath it to hide.
“Since the vehicle is high, the accused got underneath and held onto it, trying to avoid being caught by angry residents and the magistrate, who at the time was bleeding from the serious head injury,” another witness said in the statements.


The accused was retrieved from underneath the magistrate’s vehicle by the Matsapha Police, who promptly responded when called.
Magistrate Dlamini was rushed to Medisun Private Clinic where he was stitched and attended to by medical doctors.


It was also gathered that the accused was allegedly assaulted by residents of the area after the incident and was taken to the Raleigh Fitkin memorial (RFM) Hospital where he was admitted.
After he had recovered, Nsibande made a court appearance before Magistrate Lucia Lukhele at Matsapha Circuit Court.
