DNA TEST RESULTS: EX-MINER NOT DAD

MBABANE - DNA test results have exonerated a former miner who was accused of impregnating a pupil.


Elliot Dlamini (61) of Sigcaweni in the Lubombo Region insisted on the DNA test after he was suspected to have turned a Grade IV and Form II pupils, aged 13 and 17 respectively, into sex slaves and impregnated one of them.


The mother of the pupil who fell pregnant accused Dlamini of raping her daughter and pressed charges. He denied committing the offence and applied to the High Court for an order that a DNA test be conducted at a private clinic or reputable laboratory at his own expense.

Judge John Magagula granted the order.
The police, Department of Social Welfare representatives, Dlamini, the complainant and her parents as well the accused’s attorney, Charity Simelane, were present when the DNA test results were read. Dlamini was excluded as the father of the complainant’s baby. 


According to the paternity results, the samples were collected on July 23, 2019 and the final report date was August 12, 2019.
The probability of paternity, according to the report, is 0.000 per cent.


In his application for the DNA test to be conducted after the baby was born, Dlamini told the court that young girls in his community were afraid of him and they referred to him as a rapist.


Accused


Members of the community accused Dlamini of giving the teenagers polony and turning them into sex slaves.
One of the pupils fell pregnant and she identified Dlamini as being responsible for the pregnancy.


Dlamini said he was assaulted by a mob in October 2017 following suspicion that he was sexually abusing young girls in the community. Police arrested six members of the community for attacking him.


They were charged with assault with intent to cause grievous bodily harm.
Dlamini was also arrested by Siphofaneni police and they charged him with rape.


The prosecution and police, according to Dlamini, agreed that he should be released pending the birth of the baby and thereafter he would have to undergo a DNA test to ascertain if he was the father of the minor.


The former miner maintained his innocence. He told the court that he never at any point had sexual intercourse with the complainant or anyone else.
Dlamini said he agreed to wait until the baby was born to prove his innocence. He stated that in March 2018, he heard that the baby was born at the Raleigh Fitkin Memorial Hospital and the news excited him.
