MIKE MAMBA GETS E1 500 BAIL

MBABANE – After spending a night at the Mbabane Police Station, well-known Manzini businessman Mike Mamba will spend the weekend in the comfort of his home.


This comes after he was yesterday admitted to E1 500 bail by Mbabane Senior Magistrate Nonhlanhla Dlamini.
Mamba was brought to court at around 9:30am in a white police van and upon arrival, he was ushered into the courtroom by a plain-clothes police officer.
On his way to the courtroom, Mamba, who appeared relaxed, first had a brief conversation with his attorney, Sabelo Bhembe.


His matter was the first to be called and Prosecutor Chris Sibandze applied that Mamba be remanded in custody until July 14, 2019 for setting of his trial date.
Application


It was then that his lawyer applied that he be admitted to bail.  In motivating Mamba’s application for bail, Bhembe informed the court that he (Mamba) was a businessman based in Manzini and was a resident of Ngwane Park. He further submitted that Mamba would avail himself in court as and when ordered to do so.


The Crown and the defence had initially agreed that the bail should be fixed at E1 000 but Senior Magistrate Dlamini ordered the accused to deposit the sum of E1 500 into the government’s coffers to gain his freedom.
Mamba was arrested on Thursday morning.


He was charged with perjury, which is an offence of wilfully telling an untruth in a court after having taken an oath or affirmation.
Charge


According to the charge sheet, on June 5, 2019 at the High Court of Eswatini, Mamba appeared as a witness in the murder trial of Sipho Shongwe, which was before Judge Nkosinathi Maseko, being duly sworn did unlawfully and intentionally deposed and swear in substance and to the effect of the following: “The deceased (Victor Gamedze) only told him that he had a problem with Sipho Shongwe and such emanates from football.”


It alleged that when Mamba deposed and swore as aforesaid, he well knew that he had earlier on deposed to an affidavit.
In the statement he recorded with the police as per the charge sheet, Mamba reportedly stated that; “One of the things he (Gamedze) told me was that he had a problem with Sipho Shongwe and he heard that Shongwe wanted to kill him.  He said he had even reported to Labadzala (country’s authorities) that should anything happen to him, Shongwe will be behind it.”


Unlawfully


Alternatively, the Crown wants Mamba to be tried for allegedly contravening Section 5 of the Commissioner of Oaths Act of 1942 in that he allegedly unlawfully deposed and swore in substance to a founding affidavit which was submitted to the director of public prosecutions (DPP) chambers where he made averments which he later mentioned in his evidence in chief.
Mamba is expected back in court on July 14, 2019.
