THREE DIVORCE CASES IN ONE WEEK AT MAGISTRATES COURT

MBABANE – Divorce seems rife nowadays as three women approached the Mbabane Magistrates Court seeking final decrees of divorce from their husbands. 


Two of the women were granted the final decrees of divorce while one matter is still pending in court.
Noted is that most of the women cited adultery and constructive desertion on the sides of their husbands as grounds for divorce.


Some of the men did not show up in court to defend their marriages. Some of them (men) also withheld the marriage certificates which are crucial in a divorce application.


In the first case, a marriage between *Zandi and *Sethu was ended after Magistrate Sifiso Vilakati granted her a final decree of divorce.


Homestead


This was after Zandi approached the court seeking such. In her application, Zandi informed the court that she got married to Sethu in 2013 before they established a matrimonial homestead at Fonteyn.


She told the court that during the course of their marriage, her husband allegedly imbibed alcohol excessively. She claimed that the rate at which Sethu drank resulted in him losing his job.


After losing his job, Zandi alleged that her husband developed a tendency of spending more time with friends.
“He used to leave our matrimonial homestead on Fridays and returned on Sundays. He always told me that he was with his friends. This happened until I discovered that he had an extra marital affair with a local resident,” she stated.


Zandi further submitted that Sethu’s lover used to call him each time they were together. She averred that even though her husband didn’t answer his cellphone in her presence, she concluded that he was in a love relationship with the local resident after she sent him some text messages.
“I asked him and he acknowledged being in a love relationship with the resident,” she alleged.


She told the court that Sethu apologised for his actions but he never changed his behaviour.
In 2017, Zandi alleged that Sethu became abusive to the extent that he ordered her to vacate the matrimonial homestead.
As a result, she claimed that she went to live with her aunt in the same area.


She submitted that Sethu started making threats whenever he saw her.
“One day, he camped at my workplace and assaulted me. I later opened an assault case against him, which I later withdrew. I then applied for a peace binding order, however, he continued to harass me,” she alleged.
