SIPHO’S LAWYER ESCAPES LEGAL PRACTICE SUSPENSION

MBABANE – Sipho Shongwe’s attorney, Sipho Mnisi, has escaped suspension from legal practice.


This was after his legal representatives, Sithole and Magagula Attorneys, submitted an auditor’s certificate which was issued in terms of the Legal Practitioners Act No.15 of 1964.


This was after Attorney General Sifiso Mashampu Khumalo filed an application for Mnisi’s suspension from legal practice. The application was yesterday removed from the court roll.


Mnisi has represented Shongwe since he was arrested in connection with the murder of prominent businessman and football administrator Victor Gamedze.
He also once represented the country’s former Chief Justice Michael Ramodibedi during his impeachment.
Trust account certificate


The AG wanted Mnisi to be suspended from practice for suspected failure to submit to him his trust account certificate which was signed by chartered accountants.


The certificate, which is dated January 11, 2019, that was submitted on behalf of Mnisi, was issued by Ndallahwa and Company Chartered Accountants (Swaziland).
The chartered accountants stated that they examined the books of account of SS Mnisi Attorneys in terms of the Legal Practitioners Act and satisfied themselves that the law firm had complied with Section 24 of the Act. 


They stated further that the monies received on account of any person were deposited regularly and promptly into the law firm’s trust account. The books of the law firm, according to the audit, have been written up to June 30, 2018.


“We have examined the trust bank statements of the said firm for the year ended June 30, 2018, such examination revealed that the trust fund fees are strictly deposited to the trust bank account.
