MATSAPHA – Well-known business mogul Tommy Kirk became emotional as he narrated claims of how he was allegedly being victimised by Matsapha Town Council administration.

This took place when the businessman delivered his submissions before the Commission of Inquiry into the affairs of Matsapha Town Council yesterday.
As he outlined his accussations, against council, especially the office of the chief executive officer (CEO), which was occupied by the then Town Clerk Gciniwe Fakudze, a seemingly emotional Kirk was seen constantly looking up and down.

Sensitivity

Thereafter, Commissioner Benito Jones told the businessman that they understood the sensitivity of the topic he was talking about and as a result, he could be too emotional as he seemed to be.
The commissioner said they could allow him to move to another topic so that he could calm down and thereafter he could carry on with his submissions on the sensitive subject.

However, the businessman, who proved to be strong, said he was about to finish the topic and asked to carry on so that he could not confuse things.
He claimed that his family owns a plot across Lusushwana River and in 2012/13 financial year, council allegedly incorporated it into a commercial plot.
He alleged that he took the matter to court but later decided to withdraw it because he did not want anything that would draw negative publicity about the council since that could scare away investors.

All the submissions remain allegations as their veracity is yet to be tested in court.
Furthermore, the businessman alleged that this was despite the fact that council had allegedly changed the plot from an agricultural plot to a commercial one in a bid to up its rates.

Again, he alleged that at Matsamo Complex in Mahhala, the former CEO Gciniwe Fakudze, allegedly went all out to destroy him. He alleged that Fakudze sent a delegation of public transport operators who wanted to set up a bus rank in front of his complex.

Police

He further claimed that later on, the former CEO allocated the Royal Eswatini Police Service (REPS) piece of land at Mahhala, which was outside council’s jurisdiction, to set up a temporary police post.

He claimed that this was despite the fact that some years back, he had allegedly given the police a structure to use as a police post free of charge.
Currently, the businessman alleged that one of his children’s plot would soon be up for grabs as council allegedly went behind the court to obtain an order to auction the land yet the matter was still pending in the court of law.

On the same note, Kirk alleged that the incumbent CEO Lucky Sukati seems to be following in his predecessor’s footsteps. He claimed that this was because last Wednesday when he came out of the commission, he came across the incumbent CEO who allegedly said, “Tommy, basi bomber mani. Kepha nguwe lobekakhwetelalomlilo.”

“I responded by saying: ‘bengikhwetela umlilo lobaswenguwe’,” alleged the businessman.
With the above allegations, which he claimed were among others which he could not spell out because of time constraints, the businessman alleged that he was made to believe that the council, through the office of the CEO, was trying by all means to frustrate every turn he took.
