LAWYER, FRIEND ARRESTED FOR CAR THEFT

MBABANE – Manzini lawyer Thabiso Fakudze has been arrested for alleged theft of a motor vehicle.


The well-known lawyer was arrested by members of the Royal Swaziland Police based at Sigodvweni Police Station yesterday.
Fakudze (37) of Kwaluseni was arrested together with Josiah Michael Tsabedze (23), who hails from the same area.
They are alleged to have stolen a red VW Golf GTI. 


The duo is alleged to have contravened Section 3(1) of the Theft of Motor Vehicle Act 16/1991.
“In that upon or on April 1, 2017 at or near Eteni in Manzini, the accused persons each or both of them acting jointly in furtherance of a common purpose did wrongfully, unlawfully and intentionally steal a motor vehicle, a red Golf GTI registered FSD 500 BH,” reads part of the charge sheet.


According to the charge sheet, the motor vehicle was the property or was in lawful possession of Fonono Dlamini.
The complainant (Dlamini) is employed by His Majesty’s Correctional Services.
Fakudze allegedly stole the motor vehicle while it was parked at Mahhala Shopping Complex.


When the police officers discovered the car, it had already been repainted to black and was marked for sale.
Fakudze’s co- accused has also been slapped with a charge of theft under false pretences.


It is alleged that Tsabedze wrongfully, unlawfully and intentionally and with intent to defraud and steal, misrepresented to one Thanduxolo Zwane, and obtained money in cash amounting to E60 000, and promised to buy him a car.


It is alleged that by means of the said misrepresentation, Tsabedze induced, obtained and stole from Zwane the said money.
When Tsabedze allegedly took the money, he allegedly knew that what he told Zwane was not true.
Meanwhile, Fakudze yesterday moved an application for bail at the High Court where he argued that he was innocent of the charges.


In his application for bail, which was filed under a certificate of urgency, the lawyer (Fakudze) mentioned that he had two children who were dependent on him for support and maintenance and his continued incarceration was causing them great prejudice
Narrating how he was arrested, Fakudze stated that  on July 18, 2017 he was arrested by police officers based at Sigodvweni Police Station  and was subsequently charged with the offence of contravening the Theft of Motor Vehicle Act.
