LAW SOCIETY AFTER WELILE MABUZA, WANTS E36 000

MBABANE – He is now hardly seen in court corridors but the Law Society of Swaziland (LSS) is after him.


This is the story of well-known Mbabane lawyer and former football administrator Welile Mabuza.
LSS is demanding a total of E36 000, which is in respect of subscriptions allegedly owed by the senior lawyer.
Through its lawyers, the LSS has since filed an application in the High Court where it is seeking an order that Mabuza be directed to pay this amount.

LSS yesterday filed an application for a default judgment against Mabuza and it is currently pending before Judge Titus Mlangeni.
Recently, the court ordered about 15 lawyers from private practice and government to pay their subscriptions to the LSS or be disbarred.
This comes after the LSS obtained default judgments against them at the Mbabane Magistrates’ Court on Wednesday.

A default judgment is a binding judgment in favour of either party based on some failure to take action by the other party.
Most often, it is a judgment in favor of a plaintiff when the defendant has not responded to a summons or has failed to appear before a court of law.
The failure to take action is the default.
Before obtaining the default judgments, the LSS issued summons against the lawyers calling upon them to pay.  The society (LSS) was further seeking an order directing that the implicated attorneys be disallowed from appearing in court or charging fees as per the Legal Practitioner’s Act.


In its particulars of claim, the society argued that the lawyers were in breach of Law Society Bye-Laws in that they had not paid the members subscriptions as per the requirements of the  law and as such they could neither practice nor charge a fee for services as per the Act.
