HUBBY WANTS 36-YEAR MARRIAGE WITH TEACHER DECLARED BIGAMOUS

MBABANE - “I married my teacher wife under duress.”


These were some of the submissions made by a civil servant who claimed that he married his pregnant wife to save her from being expelled from William Pitcher College.


Hamilton Sipho Dlamini of Mahlanya, who has two other wives, wants the court to cancel the civil rites marriage between him and his wife Eunice Mbhamali.


 Mbhamali is now a teacher at St John Bosco Primary School in Malkerns and the couple had been married for over 36 years.
“The marriage by civil rites was nothing but a farce, it was meant to prevent Mbhamali’s expulsion on account of her falling pregnant while at the college before she was married,” alleged Dlamini.


He wants the court to declare the marriage between him and Mbhamali as bigamous.  He is further seeking an order directing the Ministry of Home Affairs to cancel and delete the particulars of the civil rites marriage of March 3, 1981 between him and Mbhamali.
In his founding affidavit, Dlamini stated that while he was stationed at Matsenjeni as a community assistant, around 1977, he met and fell in love with one Phindile Mdziniso and by 1979 they had their firstborn child.


He mentioned that on April 23, 1979 he performed the kuteka ceremony on Phindile. According to Dlamini by the time, he tekaed her he had paid a herd of 11 cattle as lobola.
Before the teka ceremony, according to the applicant (Dlamini), he informed the umphakatsi in accordance with the dictates of Swazi Law and Custom.
