STANDARD BANK GETS ORDER TO ATTACH CHALIYUMBA’S BENZ

MBABANE – An interim order has been issued to seize and attach a white Mercedes Benz ML350 belonging to Reverend David Chaliyumba.


Standard Bank Swaziland made the application as Chaliyumba is in arrears of E35 932.62 and the outstanding balance is E780 469.90 after their hire purchase agreement.
The monthly instalment of the vehicle is E21 259.48


Reverend Chaliyumba, who is one of the leading clergyman in the country, left Christian Life Centre this year after being with the church for about 14 years and founded his own church, Destiny International Christian Centre, which fellowships at Greyhound in Ezulwini.


Members of the Royal Swaziland Police Service have been ordered to assist the messenger of the court in the execution of the order in terms of Order No. 2 sub rule III of the Magistrates Court Rules as amended.
The order was issued by Magistrate Sifiso Vilakati.


“On or about April 16, 2014 in Manzini, applicant and the first respondent concluded a written hire purchase agreement in terms of which applicant sold and delivered to the respondent a certain motor vehicle, a 2014 polar white Mercedes Benz ML 350 BE with chassis/serial No. C1660572A367808 and engine No.27695530610285. Further the first respondent was to pay a deposit in the amount of E146 099.99 and thereafter pay a monthly instalment in the amount of E21 259 48.


“Consequently the said motor vehicle is depreciating in value to the loss and prejudice of the applicant.
“Therefore, the applicant humbly seeks protection against the deterioration of the said motor vehicle at the hands of the first respondent so that the said motor vehicle maybe preserved pending finalisation of this application on the declaration that the said hire purchase agreement is cancelled and the return of the said motor vehicle to applicant,” the court papers state.


The papers further state that the applicant has been informed and verily believes that the first respondent intends to dispose of the said motor vehicle to frustrate the applicant’s claim of it.
The hire purchase agreement between the man of God and the bank was to expire on April 15, 2019.
