MAGISTRATE ISSUES ORDER TO ATTACH SIBUSISO’S BMW

MBABANE – The Mbabane Magistrates Court has issued an order for the attachment of a 2008 black BMW belonging to former Minister of Justice and Constitutional Affairs Sibusiso Shongwe.


The interim order, calling for the attachment of the motor vehicle, is returnable today and Shongwe’s lawyers have filed a notice of intention to oppose. If the order is eventually made final this would be his second car to be repossessed by a bank for alleged failure to service a car loan.


The former minister is languishing at the Sidwashini Correctional facility after he was denied bail twice. Recently First National Bank (FNB), trading as Wesbank, obtained an order to repossess Shongwe’s white 2013 Isuzu KB 300 DTEQ, valued at E354 000. Shongwe is allegedly owing FNB over E261 000, which is in respect of a loan he acquired to buy the car.


In the present matter, SwaziBank is inter alia seeking an order declaring the car loan agreement it had with Shongwe cancelled.
It is further seeking an order that Shongwe be ordered to pay arrears rentals and other charges in the amount of E92 992.83.
The bank’s attorneys, from SV Mdladla and Associates, also want the court to order that a deputy sheriff be allowed to attach and remove the vehicle wherever it may be found.


SwaziBank also wants the court to direct that it is entitled to dispose of the BMW either by public auction or by private treaty.
Enock Mavimbela, who is the bank’s Executive Manager Banking Operations, informed the court that on or about March 16, 2010 Shongwe entered into a written agreement with the bank for the finance of 2008 BMW.


He said the material terms of the agreement were inter alia the following: That the bank would lend and advance to Shongwe an amount of E487 788 for the purchase of the BMW inclusive of all charges; Shongwe was to pay finance charges of E48 089 and E9 570 as additional charges and that the amount was to be payable in 60 months from the date of agreement.

why is it that the banks are acting now that he is in this state? Is it really because he has failed to pay or "kugangadvwa lese ilele phansi" I seriously do we really believe ekucedzeleni umuntfu lofako as Swazis.

They are driven by spite and ill-advice from dark corners to help Prime Minister Sibusiso Dlamini to further embarrass the not yet proven guilty Sibusiso Shongwe. Anger brings mist in the mind of a vengeful Prime Minister and his surrounding friends - going for the jargular!!

Very unfortunate and cowardice by the institutions knowing very well the man has funds frozen and not freed to own up to his obligations... Kutolunga Shongwe
