SISEKELO SUING KEITH SIGWANE FOR FAILING TO ENROL DAUGHTER
MBABANE – Businessman Keith Sigwane has been taken to court by Sisekelo High School after he allegedly failed to bring his daughter to the school despite having signed an agreement to do so.
The school is now demanding payment of E19 583.45 for alleged breach of the agreement.
The management of the school alleged that on August 13, 2007, it entered into a written agreement with Sigwane for his child to study at the school. These are allegations contained in an affidavit whose veracity is still to be tested in court and the businessman is yet to file responding papers.
The school alleged that in concluding the agreement it was represented by Kathy Thompson and Sigwane was represented by his wife, Nonhlanhla.
The material terms of the agreement, according to the management of the school, were as follows: That it was going to render educational services to Sigwane’s daughter who was to start Grade 10 in 2009: The school would then invoice Sigwane for educational services to be rendered in advance on or before the first day of each and every term and that Sigwane would pay same on presentation.
Withdraw
It was further submitted by the school that it was also agreed that should Sigwane wish to withdraw the child from the school at any stage, he must give a written full term’s notice, failing which he would be required to pay the fees in full for the following term.
The management of the school also stated that it was agreed, between the parties, that should Sigwane commit any breach of the agreement, for example fail to pay a statement presented to him, all the amounts payable by the respondent in terms of the agreement shall be payable.
