MANZINI – Ultra Travel, an agency which deals with travel bookings, will have its office equipment auctioned.

Two weeks ago, a deputy sheriff locked the agency’s offices, trading as Vogue Travel for rent arrears amounting to E77 512 while the staff was inside and ordered to vacate.

He was acting on behalf of the applicant Tisuka Properties (PTY) LTD who is represented by Sabelo Mngomezulu of Mngomezulu Attorneys.
The notice of application papers state that the pending payment of E77 512 was due and the final court order states that the sheriff was directed to attach all movable assets from the premises or enough items to cover the rentals, collection commission, interests and costs.

The items to be auctioned on March 13, 2015 include seven office desks, two double door filing cabinets, 18 office chairs, printers, a monitor, three pine chairs, desktop computers, a fridge, safe boxes, a bookshelf, reception desk, three white chairs, a computer stand and a microwave among others.

The founding affidavit states that in 2012, Tisuka Takangwane entered into a written agreement of lease with Ultra Travel which ran its full course in 2013. Thereafter, the parties entered into a month to month tenancy agreement, which was to pay the sum of E11 738 a month for rentals.
“The respondent has never disputed its indebtedness to the applicant in respect of arrear rentals and had pleaded to pay up but to no avail.

The arrear rentals have accumulated and the respondent does not own up to its undertaking to pay up. The applicant has since elected to exercise its rights and cancel the lease agreement as the respondent has accumulated a huge debt in respect of arrear rentals much to the prejudice of the landlord, which lets the property for a fee,” the papers further read.

The auction will take place at the agency’s offices, situated at Manica House, opposite the Manzini Post Office building at 10am.
