SWAZI JIVE TAKEN TO COURT

MBABANE - Swazi Jive Entertainment owner, Sakhile Nkambule is being sued for alleged failure to pay accommodation at Swazi Spa.

Swazi Spa Development Company Limited trading as  Lugogo Sun Hotel  has since instituted legal  proceedings against  Nkambule where it is  demanding  a sum of E43 689 50. According the plaintiff (Swazi Spa Development Company Limited A Lugogo Sun Hotel) the aforementioned amount was in respect of accommodation it extended to Nkambule’s company in July 2017. The plaintiff averred that despite lawful demands, the defendant allegedly failed, refused and/or neglected to pay. These are allegations contained in particulars claim whose veracity is yet to be tested in court and the defendant is yet to file his papers in the event he is disputing the claim against him.

Particulars

In its particulars of claim, the plaintiff requested the court to direct Nkambule to pay the sum aforesaid amount at the rate of nine per cent annum to  the date of the final payment including costs of suit. Nkambule has been called to within 10 days of service of the summons, he has to file his papers in the event he is disputing claim. The defendant has to file with the Registrar at the High Court, Mbabane with a notice of intention to defend and also send a copy to the plaintiff’s attorney as he will be given address (not being a post office box or post restate), which will; be within five kilometres of the court for the service upon the defendants of all notices and documents in action. The matter is still pending at the High Court and appearing for the plaintiff are lawyers from Henwood and Company in Mbabane, Mantambe House.
