BUILDERS DISCOUNT CENTRE DEMANDS OVER E1.3M

MBABANE – Its payback time. Swaziland Industrial Agencies (Pty) Ltd, which trades as Builders Discount Centre, has instituted legal proceedings for the recovery of E1.3 million from Juluka Construction (Pty) Ltd.


Other defendants in the matter are Nhlonipho Dlamini and Maklamane Gamedze.     
The company instituted a claim for the payment of E1.3 million being monies due for goods sold and delivered by Builders Discount Centre to the defendants at their specific instance and request. Neither the name nor nature of goods was precisely described in the plaintiff’s lawyers from Waring Attorneys.


Owing


“The amount of E1 326 058.57 has now become due, owing and payable,” read the simple summons in part.
The defendants, according to the plaintiffs, had refused, failed and/or neglected to pay the aforementioned amount despite demand.
These are allegations contained in particulars of claim whose veracity is still to be tested in court and the defendant is yet to file its papers in the event it is disputing the claim.


Claim


“Inform the defendant further that if it disputes the claim and wishes to defend the action, it shall within 10 days of the service upon it of the summons, file with the Registrar of the High Court, notice of intention to defend and serve a copy thereof on the plaintiffs’ attorneys.

“If the defendant fails to file and serve a notice as aforesaid, judgment as claimed may be given against it without further notice,” reads part of the simple summons.


In a separate matter, the Builders Discount Centre also filed a claim for the payment of E42 864.86.


Summons


In simple summons also issued by Waring Attorneys on behalf of the company based in Matsapha, it was explained that the owed amount was for goods sold and delivered at Haja’s specific instance and request.


Both matters are pending at the High Court where the veracity of allegations stated in the summons is yet to be tested.
