ONLY SHAREHOLDERS FOR CONTRACTORS EXECUTIVE

MBABANE – Only shareholders of construction companies will now be eligible to be members of the Eswatini Contractors Association executive committee.
This is just one of the key amendments contained in the newly-adopted constitution for the contractors’ association, which comprises of slightly more than 1 200 affiliates.


Interim Chairman Rueben Msibi explained that the resolution to the effect that the executive committee should only comprise of company shareholders had been reached by membership taking into consideration that company owners were the ones affiliated to the association.


He explained that it had been agreed by members that it would be a wise decision to have shareholders in the executive because they would make prudent decisions that would not harm the industry because it is where they derive their income.


Representing


“What happens in the case either the manager who has been appointed by the company or employees leaves the company in which they were representing in the executive?” rhetorically asked Msibi in justification of the reason they saw it fit to endorse the recommendation from the association’s membership.


As a standing rule, the contractors’ association executive should always comprise of all sectors of the contractors’ industry. These are civil, electrical, building, specialist and individual artisans among others. The chairman also announced that a new executive would be announced at a date yet to be announced. 


Confidence


Further, Msibi disclosed that under the new constitution, membership would also be at liberty to pass a vote of no confidence or recall any of the elected members of the executive committee.


“Membership strongly believes that the executive committee should always serve the interests of the affiliates. This provides the main reason why they have decided to incorporate a clause in the constitution that will allow them to recall any of the executive committee members who no longer serve their interests,” Msibi expla- ined.          

               
Recently, members of the association failed to see eye to eye with the executive committee and as a result, elections were postponed.


Unfolded


This unfolded during the SCA Annual General Meeting (AGM) which was held at The George Hotel about two months ago.
During this meeting, the executive committee was supposed to deliver a report to the general membership. However, this process was stopped as the members wanted the executive committee out of office.


On that note, the executive committee members argued that the members could not just chuck them out of office without following the law.
Thereafter, the meeting agreed that a six-member sub-committee should be elected so that they could work with the executive committee in amending the association’s constitution and also look into their elections policy.


Electing


However, the meeting ended up electing seven members and appointed Rueben Msibi from Roots Construction to be the sub-committee’s interim chairman.
It was agreed that the committees should be ready to present the amended constitution which was done in December 2018. Again, it was agreed that after presentation and eventual adoption of the constitution, they would conduct the elections for a new executive committee.
