SOLE TENDERER FOR CORRECTIONAL E3.8M FARM CHEMICALS TENDER

MBABANE – Only one company tendered for the provision of farming chemicals to His Majesty’s Correctional Services (HMCS).


Farm Services PTY Ltd, which was represented by Marius Uys, at the tender opening conducted by government officials at the Treasury Building on Friday. The tender opening was monitored by an officer from the correctional services.
When asked what probably prompted the reason why he had been the sole tenderer, Uys said he had no precise answer why other companies had not shown interest.

However, he hinted that he thought some companies did not submit tenders because the tender was issued during the course of the festive holidays, when a majority of companies were closed. He said he had been working for the duration of the festive season, which provided the reason why he was ready to make the submission on time. Uys disclosed that his price for providing the required service was E3.8 million.


The tender where Uys does not have a competitor will be conducted in accordance with the Swaziland Public Procurement Act of 2011.
It should be mentioned that over and above being legally obligated to publish tenders with Swaziland Public Procurement Regulatory Authority (SPPRA), all public enterprises and government departments are compelled to pay E5 000 to the agency as a ‘handling’ fee.


This is according to SPPRA circular number two of 2017, which was issued in terms of Sections 20 (c) as read with Section 66 and 10 (c) of the Public Procurement Act No.7 of 2011 (the Act), which provides for the payment of fees for services rendered by the agency.


All procuring entities are required to send all tender documents, adverts and notices inviting tenderers and suppliers to participate in procurement proceedings to the agency prior to any form of advertisement or publication in accordance with the Act.  The circular refers to the following procurement methods and notices; Invitation to Tender (RFT), Request for Proposals (RFP), Expression of Interest (EOI), Request for Information (RFI), Request to Pre-Qualify and Limited Tenders (where prequalification is done nationally).


“Invitation to Tender documents sent to the agency for compliance checks should be accompanied by a purchase order or proof of payment or commitment to pay. The agency will charge a fee of E5 000 per tender for the entire duration of the tendering period,” reads the circular in part.


 The agency emphasised that this intervention was intended at ensuring that procuring entities issued invitations to tender, notices and advertisements that were aligned to public procurement procedures, rules, processes and guidelines.
