MASHUMI IN COURT TO AVOID DC – FA

MBABANE – Judgment has been reserved in the matter involving suspended NFAS Vice President Mashumi Shongwe and the country’s football mother body.


Shongwe, who was elected Shiselweni Regional Football Association (SRFA) Chairman while still serving in the National Football Association of Swaziland (NFAS), ran to court to challenge his suspension by the supreme soccer body.
Also affected was the region’s whole executive committee elected on the day.


The veteran football administrator was suspended immediately after the SRFA elections by the NFAS for failing to heed to a directive to step down before the regional polls.


The landmark case was before Principal High Court Judge Stanley Maphalala yesterday and the NFAS, through its lawyers, challenged the court’s jurisdiction over the matter.


In their arguments, the defence lawyers in Noel Mabuza and Banele Ngcamphalala, argued that Shongwe rushed to court to avoid a pending disciplinary case against him.
“The applicants rushed the matter prematurely without exhausting the football structures that include an independent Arbitration Tribunal,” said the defence.


“The suspension is pending appearance before a disciplinary committee.”
Shongwe, through prominent lawyer Mandla Mkhwanazi, had used Section 33 of the country’s Constitution to justify the decision to take the matter to court, stressing that his client was treated unjustly and unfairly.
