SHERRIFF ATTACHES SOCCER STAR ‘THEO’S CAR

MBABANE – A deputy sheriff has attached a motor vehicle belonging to Malanti Chiefs midfielder, Sandile ‘Theo’ Motsa.


The car, a red VW Golf registered ESD 222 CM,   was taken from the player on Thursday after car dealer, Mxolisi Magagula, who sold him the sedan, ran to court seeking an order that the agreement between him and  Motsa be cancelled after he allegedly defaulted in payments. The car is valued at E130 000.


The interim order was issued by Mbabane Magistrate Phathaphata Mdluli after the car dealer’s representative moved an exparte application (application moved without informing the other party).
In his founding affidavit, Magagula stated he entered into an oral agreement of sale in July 2015 with Motsa, whereby the lanky midfielder was required to pay a deposit of E40 000 to have the car delivered. The car was delivered. The balance of E90 000 was supposed to be paid within a period of two months.


“The respondent duly paid the required deposit in the sum of E40 000. The respondent has defaulted in payment of the monthly instalments which are provided for in the oral agreement and has effectively stopped making any payments,” said Magagula.


These are allegations contained in an affidavit whose veracity are still to be tested in court and Motsa has been called to show cause why the order should not be made final. Magagula wants the agreement terminated to claim immediate possession of the vehicle on fears that its value will also depreciate. “With each passing day, the risk of loss and/or damage to the motor vehicle persists,” said Magagula.
The applicant is represented by Mbhekwa Mthethwa under C.J. Littler & Co. in the matter.
