MORE WOMEN REPORT ABUSE CASES AGAINST LAWYER

MBABANE - The arrest of the well-known lawyer, who is accused of raping and impregnating his children, has seemingly opened a can of worms.

Several women are reportedly coming out of the closet to report their horrific experiences allegedly at the hands of the attorney.  According to the investigator of the cases, Inspector Millicent Dlamini, more charges were likely to be added against the lawyer. “After he was arrested, we have had an influx of people who have come out to report some of the atrocities that he has allegedly done in the community.  I can confidently state that we are investigating a number of other offences that link him to other rape allegations and that we shall, therefore, be adding new charges to the ones we already have,” submitted the investigator.

Charges

She informed the court that the charges were not the same anymore and the possibility of them being amended was high, especially now that they (police) were also receiving calls informing them about the lawyer’s alleged criminal activities. The lawyer is alleged to have impregnated his children and forced them to take abortion tablets. Two of the minors and his helper allegedly gave birth to his children. It is alleged that one of the children fell pregnant six times and committed six abortions at the instance of the lawyer. One of his daughters, his niece and a helper, allegedly gave birth to the attorney’s children after failed abortion attempts at his instance. The minors were allegedly sexually abused by the lawyer for years, beginning from when some of them were as young as 12 years old. “This is just only a tip of the iceberg as there are more crimes that are surfacing in the wake of the applicant’s (lawyer) incarceration. We are further investigating some other allegations,” submitted the investigator.

She contended that his release from custody would undermine the proper function of the criminal justice system. Inspector Dlamini, who is based at the Tshaneni Police Station, further submitted that the evidence against the applicant was overwhelming. “I submit, therefore, that the acts perpetrated by the applicant to his own flesh and blood are synonymous with that of a sex pest,” contended Inspector Dlamini. The investigator further told the court that she had strong and compelling evidence against the applicant, which pointed to him as the one who committed the offences he was charged with. She argued that bare denial would not suffice, as the evidence directly pointed to the applicant as the one who allegedly committed these despicable atrocities to his own children, who expected to be protected by him (their father). She further brought it to the attention of the court that the applicant did not only sexually molest his own children, but also his maid who was working in his house.

Complainants

“The complainants have no reason to be just spiteful against the applicant and it has taken a lot of courage for them to come out in the clear about the heinous acts committed to them. At the time of commission of the offences they were still minors,” she argued. She informed the court that the lawyer was the father to some of the complainants and he allegedly breached the relationship of trust to them. Inspector Dlamini also dismissed the allegation by the lawyer that the complainants were vexatious as the evidence allegedly showed that he was the one who committed these shrewd criminal acts. “One of the survivors stated that she was in Form 1  and aged 13 years when he started touching her inappropriately and getting sexual with her. She will tell the court that this happened in 2006 and the applicant then had sexual intercourse with her almost every day, such that she then fell pregnant. The complainant was very afraid of her father and kept the sexual assault a secret,” averred the investigator.

The investigator further told the court that one of the children, who was 14 years old and staying in the homestead of the applicant, also allegedly fell pregnant and  he took her to  South Africa for abortion. “Between ages 13-16 years, the complainant will say that she fell pregnant for the applicant six times and committed six abortions. Three of those illegal abortions were committed in South Africa and the other three were committed in Eswatini, with the help of the applicant’s sister. I must quickly mention that we are still investigating the applicant’s sister’s involvement in the commission of these crimes,” submitted Inspector Dlamini.

Pregnant

She alleged that one of the children, who is a sister to the lawyer, fell pregnant and had his child. “Another one who has the applicant’s child is the maid who was taking care of his children. “The applicant is a danger to society and he ought to be kept in custody pending his trial. He is closely related to the witnesses and there is no way in which he cannot interfere with them. My fear is that he will threaten the crown witnesses and try to intimidate them not to testify against him,” she argued. The investigator further narrated to the court that in 2016, the lawyer allegedly again  sexually assaulted one of his children, who was 14 years  old, and was staying at home with him until she ran away to stay with her relatives in Manzini. The bail application will be argued before Judge Zonke Magagula tomorrow.  The lawyer is represented by Khumbulani Msibi while appearing for the Crown is Bhekiwe Ngwenya.
