BUSINESSMAN’S ‘SEX TAPE’ LEAKED

MBABANE – A sex tape allegedly featuring a well-known Mbabane businessman is trending on social media.

They were salacious revelations in the video footage that purportedly show a woman enjoying touching the entrepreneur’s ‘trouser snake.’

The successful businessman whose companies do business with both government and the private sector is first shown in a house with three women who made provocative dance moves. As he walks past two of them, where he appears to be touching the one wearing casual jean shorts on her back while the other woman who was wearing a revealing dress continues to exhibit booty shake dances.

One woman who is understood to be related to him is seen cheering the booty shake dances. The businessman did not snuggle up to the third dancer who was wearing white pants. 

The fun proceeded to Xchange Lounge and Shisanyama in Ngwane Park, Manzini where another woman who, at some point, referred to him as ‘baby’ placed her hand inside his waistband. The video footage shows them enjoying alcohol there.

In an interview a fortnight ago, the businessman whose name is withheld for now pending our investigation into whether his wife was present or not during the house party said he was aware of the video footage.

His name will be published in due course.

He suspected that it was recorded merely to blackmail him. He said a police friend advised him to prefer charges against the person who took the video and posted it on social media.

Asked if his friends were helping him to deal with the embarrassing situation, he said he also felt betrayed by his own friends. He said he did not trust anyone.

After seeing the video, he said people from as far as Cape Town sympathised with him. He said an official from the Ministry of Public Works and Transport also gave him words of comfort.

He disclosed that he was happy that his wife understood his predicament and explanation that there was nothing sinister with his conduct at Xchange Lounge.

At the time of the interview, he did not know who recorded the video footage. 

While the businessman was having good time with these women, it must be said that someone live-streamed the incident on Facebook, and many people condemned the businessman for what they described as unfortunate shenanigans or dishonest activity.    

“I don’t think I have to lie to myself that I have friends now,” he said.

“They (friends) wouldn’t have allowed the leakage of this video.” He said life continues as he was not the first person to be in such an embarrassing situation. 

 

Gigaba debacle used as example

He made an example of Malusi Gigaba, the former Minister of Home Affairs in South Africa, who also had to deal with a similar situation where his sex tape trended on social media.

Further asked what he was doing to the woman, he responded that he was passing-by and negotiating for passage. 

However, he also appeared to be expressing shock at the vulgar language used by the woman who put her hand inside his waistband.   

The Times SUNDAY can mention that the distribution part of the video could be viewed as illegal. 

Legal sources who did not want to be quoted as they claimed to have seen the video and also knew the businessman said the police who advised the businessman to prefer charges against the person who captured the video should have also given him advice on what public indecency is as the incident occurred in a public place.

The Sexual Offences and Domestic Act, 2018, puts great emphasis on ‘consent’. It could not be immediately ascertained if the booty shake dancer consented to the ‘back touch.’

However, the law, which is known as SODV, describes sexual exploitation as sexually assaulting a person or allowing a person to be sexually assaulted or encouraging, inducing or forcing a person to be used for the sexual gratification of another person.

It also means using a person in or deliberately exposing a person to sexual acts or pornography or procuring or allowing a person to be procured for commercial sexual exploitation or in any way participating or assisting in the commercial sexual exploitation of a person.  

Section 5 (1) states that a person who unlawfully commits a sexual violation against another person, without the consent of that other person commits the offence of sexual assault. 

It is provided in subsection (2) that a person who commits the offence of sexual assault shall, on conviction, be liable to pay a fine not exceeding of E30 000 or imprisonment for a period not exceeding 15 years or both.

Nonhlanhla Dlamini, the Director of Eswatini Action Group Against Abuse (SWAGAA), advised inhabitants of Eswatini that the touching of private parts during dances should not happen, but couples should reserve it for bedtime or rather do it in the bedroom.

Dlamini mentioned that any sexual acts occurring in public should be condemned. “I don’t understand why someone will touch another’s private parts in public, it doesn’t make sense,” she warned.

Phindile Vilakati, the Chief Police Information and Communication Officer, said she needed to peruse the law to ascertain which specific provision prohibited people from posting and distributing pornographic material.

She said it was true that the touching of bums or private parts could lead to other people claiming to have been violated.
