RA, BROTHER ‘WAR’ RAGES ON

NHLANGANO – Lubombo Regional Administrator (RA) Themba Msibi has sought the court’s intervention in the raging war with his brother over their late parents’ homestead.


This was after the RA’s younger brother, Maguzumbela Msibi, got in his way and stopped a tractor he had sent to till the land at their parental homestead, which is located at Ngudzeni, about 40km to the south-east of Hlatikhulu in the Shiselweni Region.
This came as an unpleasant surprise to the former Speaker in the House of Assembly in Parliament as he was preparing for the planting season following the recent rains.


Unrelenting, Msibi sought the help of police officers and continued preparing the land.


Barring


Subsequent to that, Msibi further approached the Nhlangano Magistrate’s Court yesterday, where he was seeking an order barring his brother from interfering with the property at Ngudzeni.


In his submission, Msibi told the court that after their parents’ demise he remained in occupation of the property, through somebody he hired to look after and further maintain the place.


He said his attempts to develop and to try and get benefits from the soil on which the homestead stands have been met with resistance from his younger sibling, who, allegedly, would either send someone to prevent him from doing so or thwart such efforts himself.
Msibi claimed that his brother had always been confrontational and would at times issue death threats when causing the disturbances at their homestead.


Battles


This reportedly plunged the family into endless court battles, resulting in an order barring Maguzumbela from interfering with anything to do with Themba’s property at the homestead.


The RA complained that this particular court order could not give him enough protection from his brother, hence the reason why he was back at the same court seeking another order barring his sibling from interfering with his homestead.


Maguzumbela was present in court to argue his case but instead he elected to seek the services of an attorney. He claimed that he was caught off guard and had not been aware of why he had been hauled to court in the first place.


Ultimately, and in the absence of any evidence from Maguzumbela to the contrary, the court had no choice but to issue an interim order in favour of the RA. The ruling was made by Nhlangano Principal Magistrate Florence Msibi yesterday in terms of Section 83(1) of the Sexual Offences and Domestic Violence Act 15 of 2018.
The pair is expected back in the same court again at a later date where the matter will be argued.
