GOVT FAILS TO RELEASE E1M FOR CASSPIR VICTIM

MBABANE – It was a bitter sweet moment for the UNESWA student who was run over by a police Casspir.

This, because her recent presentation with a house by God’s Glory Ministries came at a time when she is also still expecting to receive her compensation from the Royal Eswatini Police Service. Despite having agreed to compensate her with a sum of E1 million as full and final settlement, government has still not paid her any cent. According to the deed of settlement, government was expected to have paid Ayanda Dolly Mkhabela in full not later than August 31, 2019.

In a letter dated May 21, 2018, Principal Crown Counsel Ndabehle Dlamini wrote to Mkhabela’s attorneys where he stated: “Out of desire to find quick closure to this unfortunate case, client (Royal Eswatini Police Service) offers E1 million in full and final settlement.” Mkhabela of Nhlangano was initially demanding a compensation of E3.7 million from the national commissioner of police.

Her lawyers from TR Maseko Attorneys prepared a deed of settlement which government is reportedly now reluctant to sign.  On April 23, 2019, Mkhabela’s legal representatives also wrote to the attorney general (AG) asking his office to speed up the settlement. “Per our letter dated March 5, 2019, please speed up the settlement. Client needs the money so she may get on with her life. You will recall that in our previous letter, we alerted you of the unfortunate state of client’s wheelchair,” reads part of the correspondence written by Mkhabela’s lawyers to the AG.

The AG was further asked by Mkhabela’s legal representative to demonstrate that his office was negotiating in good faith, not just stalling the matter. In her particulars of claim, Mkhabela stated that on February 22, 2016 at UNESWA Campus, next to the Multipurpose Hall adjacent to the Faculty of Engineering Building and the arena usually used for graduation purposes, she was run over by a Casspir belonging to the Royal Eswatini Police Service. She submitted that after the accident she lost consciousness and she woke up the following day at the Raleigh Fitkin Memorial (RFM) Hospital in Manzini.  Mkhabela pointed out that due the complications and severe injuries she was transferred to Manzini Clinic, a private hospital.
