FINED E8 000 FOR ASSAULTING LOVER

MANZINI - Assaulting his girlfriend after suspecting that she is cheating on him with a pastor has seen a man parting with E8 000.   


 This was after he was charged under theh SODV Act and slapped with a hefty sentence of paying fine to the tune of the aforementioned amount or to face four years imprisonment.


 Makhundu Tfwala (54) from Ntabamhloshana lived up to his name ‘Makhundu’ which could be loosely translated into English as knobkerrie, when he assaulted his girlfriend with the same weapon.


Tfwala is said to have wrongfully and unlawfully assaulted Siphiwe Mdluli once on her left thigh with intent to cause grievous bodily harm.
He committed the offence on August 7, 2019 at Ngculwini in the Manzini Region.


Tfwala made his court appearance before Magistrate Simangele Mbatha at the Manzini Magistrates Court.
When narrating the events leading to the commission of the offence before court, Mdluli cited that she was involved in a love affair with Tfwala for a period of three years after her husband died a few years before the commencement of their relationship with Tfwala.


Mdluli relayed before court that on the day the offence was committed, she was with one Lomalungelo in her house preparing for a church service that was scheduled to take place at her residence.
She said while preparing for the church service, Tfwala walked into the house and sat on a chair.


Derogatory


She asserted that soon after sitting on the chair, Tfwala began to hurl derogatory expletives towards her, accusing her of being in a love relationship with the pastor who was expected to come and conduct the service.


Mdluli said thereafter, Tfwala probed her about the cutlery that would be used to serve the pastor and when she informed him that she was going to use a special tea set instead of the usual ones she used to serve tea, Tfwala sprang up from the chair and knocked her against a fridge while attempting to throttle her.


“Luckily I managed to escape. I went out of the room and raised the alarm,” she said.
However, Mdluli mentioned that her effort to escape was in vain as Tfwala pursued her and after catching up with her, proceeded to assault her with the knobkerrie once on her thigh.


She narrated before court that during the squabble, the pastor arrived at her homestead and to his dismay, he found Tfwala assaulting her and he watched from a distance.


Mdluli said when the accused saw the pastor he then began to hurl insults at him as well, accusing him of being in a love relationship with her. She said the pastor tried to calm him down but in vain as he continued to insult him probing him why he was not married.


“He yelled at the pastor and asked him what kind of a pastor he was since he is not married,” she said.
Mdluli said police were called and they came and detained the accused person.


During mitigation, Tfwala pleaded with the court to be lenient with him when passing sentence.
However, his plea seemingly fell on deaf ears as Magistrate Mbatha sentenced him to four years in prison with an option to pay a fine of E8 0000.
