COMPANY DEMANDS E7.6M FROM MTN ESWATINI

MBABANE – MTN Eswatini Limited has been hauled to court over alleged unpaid commissions to the company that was responsible for Mobile Money transactions.

Money Transfer Africa is demanding payment of MoMo Airtime commission amounting to E7.6 million. Money Transfer Africa (PTY) Ltd, which in the purported agreement between the parties is referred as the Super Agent of Mobile Money, is a locally based company in Manzini. In its particulars of claim, Money Transfer Africa alleges that on June 15, 2012, while represented by Dean Johnston, it entered into a written Super Agent Mobile Money Agreement with Eswatini MTN.

MTN Eswatini at that time was reportedly represented by Ambrose Dlamini, the former Chief Executive Officer. Dlamini is currently the country’s Prime Minister and it should be noted that this happened before he was appointed into the current position. These are allegations contained in an affidavit whose veracity is yet to be tested in court and Eswatini MTN is yet to file its papers. The total amount of money being demanded by Money Transfer Africa is E7 660 939. According to the plaintiff (Money Transfer Africa (PTY) Ltd), notwithstanding proper demand, the defendant (MTN Eswatini) has allegedly failed and/or refused to pay the aforementioned amount. Money Transfer Africa (PTY) Ltd averred that MTN Eswatini was liable to pay it commission for airtime transactions purchased with Money Mobile stock (ongoing airtime revenue) in the amount of E7 660 939.

According to the plaintiff, the terms of the agreement were that MTN Eswatini appointed it to promote and facilitate the distribution of Mobile Money stock to the latter’s authorised agents in the Kingdom of Eswatini. The plaintiff alleged that it was appointed to sell and provide real time value to Mobile Money agents for the purchase and distribution of mobile money stock as provided in the agreement. It was submitted that Money Transfer Africa would purchase Mobile Money stock from MTN Eswatini and trade the Mobile Money stock directly to Mobile Money agents and further distribute and sell Mobile Money stock on the defendant’s behalf at a price stipulated by MTN Eswatini from time to time.
