METROPOLITAN CHURCH SUED FOR E334 716

MBABANE – From being one of the much celebrated churches in the country, Metropolitan Evangelical Church has become a regular feature at the High Court.


A company which allegedly supplied building materials during the construction of the church is demanding over E300 000.
Metropolitan Evangelical is one of the biggest churches in the country which was founded by the late popular Evangelist Kaiser Fakudze.
The exact amount which Zimpa Investment (PTY) Limited is demanding from the church is E334 716.42.


Through its attorney Mbhekwa Mthethwa of CJ Littler, the company has instituted legal proceedings against Metropolitan Evangelical Church.
In its particulars of claim, the plaintiff, (Zimpa Investment (PTY) Limited) stated that between the period of October 2016 to August 2018, it rendered services to the defendant (Metropolitan Evangelical). According to the plaintiff it supplied and installed aluminium sliding door, fixed windows, doors, aluminium facade, aluminium flush glancing and aluminium skylights at the defendant’s church in Fairview, Manzini.


The parties, according to the plaintiff, entered into an oral agreement for the aforementioned services. When the parties entered into the oral agreement, the company was reportedly represented by Myeni and appearing for the church was Sifiso Dlamini.  It was allegedly agreed that the church would pay upon being invoiced by the plaintiff as the project continued.


“The plaintiff duly invoiced the defendant for the services rendered but the defendant has failed and/or neglected to pay. Currently the defendant is indebted to the plaintiff in the sum of E334 616.42,” reads part of the company’s particulars of claim.


It is alleged that notwithstanding being invoiced for services rendered and even after a demand being made, the church had failed to pay the company.  
Interestingly, the church also recently instituted legal proceedings against the Eswatini Government where it is demanding E139 206.38. This after a motor vehicle owned by the State collided with a car belonging to the church.


When the accident happened there were six passengers on board the vehicle belonging to the church.
According to a police report annexed to the court papers, all the passengers were injured and they were rushed to the Raleigh Fitkin Memorial (RFM) Hospital where they were treated and discharged. The church has since instituted legal proceedings against the Eswatini Government where it is demanding payment of the aforementioned amount.


Respondents in the matter are, the government’s driver, Ministry of Natural Resources and Energy and the Attorney General.
In its claim the plaintiff (Metropolitan Evangelical Church International)  stated that on or about April 11,2017 near Phonjwane along Siphofaneni/Hhelehhele MR 8 Public Road, a Toyota Legend registered JSD 199 CM  collided with a Toyota Double cab registered GSD 077GE. The government motor vehicle was allegedly driven by one Walter Hlatshwayo.
