SIKHUMBUZO FOUNDATION SUES EX-MP OVER E10 000 DONATION

MBABANE – Sikhumbuzo Foundation has taken Matsafeni Investment, whose MD is Gilgal Member of Parliament candidate Sithembiso Ngudze Mamba, to court over a E10 000 donation.


Matsafeni Investment (PTY) LTD is the first respondent in the matter while Mamba is the second. The Sikhmbuzo Foundation is demanding a payment, with immediate effect, of E10 000 together with interest of 10 per cent per annum.


This is contained in a provisional sentence summons issued last Friday.
The foundation is further demanding that the interest on the claim run from the date the obligation became due to the date, of payment.


According to the summons, the foundation is also demanding that costs of suit at attorney and own client scale which sums the defendant owes and unjustly fails neglects and/or refuses to pay to the applicant by virtue of dishonoured cheques drawn by the respondent in favour of the applicant.


The summons state should the respondent fail to make such payment, he (respondent) is called upon to appear before the High Court personally or by being represented by counsel on Friday. This is, according to the summons, for the purpose of hearing the matter so the respondent could admit or deny its liability to the said claim.


The defendant was advised to file an affidavit with grounds of his defence on the said claims if he denied liability. The defendant was further advised to state whether it admitted or denied its signature to an acknowledgement of debt.
Through the summon, the court instructed the sheriff or his lawful deputy for the District of Hhohho, to inform the defendant that the court might grant a provisional sentence against it should it fail to do the aforementioned things.
