WIFE WANTS PATERNITY TEST FOR ‘VICTOR’S DAUGHTER’

MBABANE – Let’s do a paternity test before we start talking! The wife of the late businessman Victor Gamedze wants the court to compel a woman who claims to be his biological daughter to undergo a paternity test.


A paternity test is a medical test, typically a blood test, to determine whether a man may be the father of a particular child.
The woman, Nosipho Gamedze, who is in her 30s, wants to be included as a beneficiary in Gamedze’s multimillion estate.


Lungile Hotencia Gamedze, who is the wife of the late businessman, together with her two daughters, Tiyandza and Temalungelo, have since filed an application at the High Court. Gamedze, who was a businessman and soccer administrator, died on January 14, 2018 after he was gunned down at Ezulwini Galp Filling Station. The trio wants the court to compel Nosipho to undergo a paternity test within 10 days.  This comes after Nosipho, who has been cited as the first respondent in the matter, allegedly refused to avail herself for a paternity test.


Lungile and her two daughters are seeking an order directing Nosipho to undergo a paternity test at Ermelo Provincial Hospital, Mpumalanga in South Africa. In their application, they  averred that the reason for the application was to ensure that they were not unduly prejudiced and disadvantaged in relation to the quantum that they were due to derive from the estate of the late businessman, in the event the paternity test showed that Nosipho was not the late businessman’s child. “Similarly and more importantly, the application equally ensures that Nosipho was treated equal as an heiress or beneficiary of the said estate, in the event the paternity test yields positive results,” submitted the late businessman’s wife and her children.


They further claimed that they were presently uncertain of the paternity of Nosipho, one way or the other.
“As prelude to this application, a written request was made to the first respondent (Nosipho) by letter dated July 20, 2017.  By letter dated July 27, 2018, Nosipho flatly refused to subject herself to such a test, hence the need for verification of this through this application,” alleged Lungile.


Through her attorney Mlungisi Khumalo of Khumalo Attorneys, Lungile contended that the High Court had jurisdiction to hear the matter by virtue of the fact that the cause of action occurred within its jurisdiction,  and due to the fact that the parties were domicile within the Kingdom of Eswatini.
Nosipho is the same woman who recently approached the Master of the High Court after she was reportedly excluded from the estate of the late Gamedze.
The estate file was opened at the office of the Master of the High Court in Lubombo.
During the funeral of the late businessman, it was mentioned that he was survived by his wife Princess Lungile and four children; Ngeti, Tiyandza, Tema and Gift.
The total value of the assets which form part of the estate is still to be ascertained as procedurally, the evaluation of the property is done. 
The process may involve deciding whether to sell real estate or securities owned by Gamedze and decide whether or not probate court proceedings are needed.
Gamedze was known to be a wealthy man as he had more than 10 companies and an undisclosed number of properties that are expected to be disclosed during the winding up of the estate and distribution of his will.
