SIPHO FILES URGENT BAIL APPLICATION

 MBABANE – “I have been incarcerated for five months now and I have still not been furnished with evidence linking me to the alleged murder.”


This was the submissions of Sipho Dumisani Shongwe, who stands charged with the murder of prominent businessman and football administrator Victor Gamedze.


He is adamant that the case against him was very weak and as a result, the Crown had also failed to furnish him with the list of witnesses and summary of evidence despite numerous requests by his lawyer.


Shongwe yesterday filed an urgent application at the High Court where he is inter alia seeking an order for the continuation of his bail hearing and the setting aside of the appeal that was filed by the Crown.


His initial application for bail was halted after the Crown noted an appeal following Judge Sipho Nkosi’s finding, that it (Crown) had failed to prove that Shongwe escaped from Barberton Maximum Prison.


The reason the appeal is not proceeding is due to the fact that Judge Nkosi has still not filed his reasons for his finding.
In his fresh application, Shongwe submitted that the Crown had up to date failed to indict or commit him to the High Court for trial.
“The manner in which the matter is being prosecuted is inhuman and unfair.

It is a history of injustice,” submitted the murder suspect.
Giving a background of the matter, Shongwe told the court that on or around January 19, 2018, he was arrested at Ngwenya Border Gate by police officers based at the Mbabane Police Station. He alleged that after his arrest, he was detained at the Mbabane Police Station without a charge and was also denied an opportunity to consult with his attorney or his wife.


He alleged that he was formally charged with murder on January 21, 2018 in the presence of his attorney without any prior consultation.
Shongwe pointed out that on the same day, he appeared for a remand hearing. He said he was currently kept at the Matsapha Maximum Correctional facility awaiting committal to the High Court.
