NO TOILET ACCESS, SOLITARY CONFINEMENT FOR SHONGWE

MBABANE – Being kept in solitary confinement without access to a toilet is one of the restrictions murder suspect Sipho Shongwe has to endure on a daily basis.


“As I am in solitary confinement, it is even worse. They close at 3pm for meals and I have no access to a toilet from 4pm until 8am the following day,” submitted Shongwe.


Solitary confinement is a form of imprisonment in which an inmate is isolated from any human contact, often with the exception of members of prison staff.
Shongwe, who stands charged with the murder of prominent businessman Victor Gamedze, disclosed the hardship he was facing in prison in his court papers where he is fighting for his release from custody.


He averred that there were a number of restrictions on when and where he might have food.
Shongwe further submitted that the facility at Matsapha was not conducive for a meaningful consultation with his legal team.
According to Shongwe, he was separated by a fence from his legal representatives.


“We are not accorded sufficient privacy as the guards stand by the windows and attempt overtly to listen to the conversations between me and my legal team,” submitted the murder suspect.
He insisted that he was in solitary confinement and the cell had no toilet.


Shongwe also alleged that he was a sickly person who needed constant medical attention which was not available in prison.
Shongwe’s submissions are in contrary to those that were made by the Principal Investigator of the matter, Senior Superintendent Sikhumbuzo Fakudze.
In his opposing affidavit, Fakudze alleged that the correctional services had officers who looked after the health of inmates.
