JUDGE MPENDULO FIRED

MBABANE – After having received a salary of over E1 million for 27 months for doing nothing, Judge Mpendulo Simelane has been fired.


Simelane, who has been on suspension since April 2015, was fired by His Majesty the King for serious misbehaviour.
His services were terminated through a Legal Notice dated July 6, 2017.


“In exercise of powers vested in me under Section 158(2) of the Constitution of Swaziland Act, 2015, I, King Mswati III, King and Ingwenyama, hereby remove Justice Mpendulo Simeon Simelane from office of the High Court of Swaziland for serious misbehaviour, with effect from date of signature of this Notice,” reads part of legal notice.


Section 58 (2) of the Constitution provides that: a Justice of a superior court shall not be removed from office except for stated serious misbehaviour or inability to perform the functions of office arising from infirmity of body or mind.


Simelane’s dismissal by the King comes after he was impeached by the Judicial Service Commission (JSC) for misconduct. 
Impeachment is a formal accusation of wrongdoing against a public official.


The impeachment proceedings were prosecuted by senior lawyer Zweli Jele from Robison Bertram.  This is the same lawyer who successfully prosecuted in the impeachment of former Chief Justice Ramodibedi.


Judge Simelane was found guilty of serious misbehaviour in that he knowingly and willfully presided over the matter involving the then Chief Justice Ramodibedi versus the Swaziland Revenue Authority, knowing that he was precluded from presiding over the matter.
