EX-COP TAKES PM TO COURT

MBABANE – A former police officer, who was dismissed from the Royal Swaziland Police after he was convicted of drink-driving, has taken the Prime Minister (PM), Sibusiso Barnabas Dlamini to court.


Sifiso Sibandze, who was based at Matsapha Police Station, wants the premier to provide reasons why he upheld the decision of the national commissioner to dismiss him from work. Sibandze was arrested while off duty.
He contended that the PM simply made his appeal a mere formality and in so doing, rubberstamped the incorrect decision of the national commissioner of police.


National Commissioner of Police Isaac Magagula has been cited as the second respondent in the matter. The PM is the Chairman of the Police Appeal Board.
Sibandze is, among other things, seeking an order reviewing, correcting and setting aside the PM’s decisions.
He wants the court to reinstate him to the police service and also to direct the Royal Swaziland Police to pay his salary arrears calculated from February 28, 2014 to the date of his reinstatement.


The former police officer contended that the prime minister, as chairperson of the appeal hearing failed to apply his mind, by not affording him an opportunity to explain and make submissions on the grounds of the appeal he noted.


 He told the court that he had the desire to demonstrate how grossly unreasonable the decision of the national commissioner of police was, but that right was allegedly not afforded to him.
