COURT POSTPONES UNIONS’ ‘DVULADVULA’ AGREEMENT CASE

MBABANE – The fear of being haunted by past experiences has caused public sector unions to approach the court for an order to enforce the collective agreement they entered into with government.


Swaziland National Association of Teachers (SNAT) Secretary General Muzi Mhlanga said as public sector unions, they have learnt from previous encounters with government that collective agreements should be made an order of the court.


Mhlanga alleged that government, after reaching an agreement with the unions, would not fulfil its end of the bargain. He said this has necessitated that the unions file the present application in the Industrial Court, where they seek that the collective agreement they reached with government should be made an order of the court.


The collective agreement was concluded between the unions and government during the negotiations for the salary review, which brought about the euphoria around the ‘dvuladvula’ bumper pay.
Judge Nkosinathi Nkonyane yesterday ordered that the unions should serve the labour commissioner with their application. The matter was postponed to today. 


SNAT and the Swaziland Nurses Association (SNA) are applicants in the matter and they are represented by Sipho Madzinane of Madzinane Attorneys. The government negotiation team and the attorney general have been cited as respondents.
The Joint Negotiations Forum (JNF) commenced negotiations on the salary review on May 10, 2016. The negotiations continued in a series of meetings until July 6, 2016, where the parties reached an agreement.
