MP FRANS SERVED WITH WRIT OF EXECUTION FOR E20 500

MBABANE –MP Frans Dlamini has been served with a writ of execution demanding that he pays E20 503.34 for legal costs emanating from a matter in which he was taken to court and ordered to pay Heavy Plant Centre (Pty) Ltd E45 000 after it repaired a truck he allegedly bought from MP Sitezi Dlamini.


Dlamini (Frans) and Dlamini (Sitezi) are Members of Parliament for Nhlambeni and Dvokodvweni constituencies, respectively. MP Sitezi allegedly sold his Volvo truck to MP Frans after he failed to settle the E45 950.97costs of repairing the vehicle. According to the Director of Heavy Plant Centre, Zwelithini Zulu, Sitezi indicated that he had sold the truck to Frans whom he alleged to have undertaken to settle the costs of repairing it.

Frans is alleged to have confirmed in an affidavit that he would settle the amount. He allegedly paid two instalments of E15 000 in September and October 2015. In December 2015, he allegedly paid E6 000. Zulu said the MP paid the monies after numerous demands by a deputy sheriff. The veracity of these allegations is still to be tested in court.


A bill of costs was then taxed by the taxing master for the fees that had been granted by the court in favour of Heavy Plant Centre.
The MP submitted that he was served a writ of execution demanding the settlement of the amount of E20 503.34 in respect of legal costs which are payable to Heavy Plant Centre’s attorneys.


Instead of settling the bill, Frans has filed an application in which he seeks a review of taxation and he wants the taxed bill to be set aside and be declared unlawful or irregular.
He mentioned that the bill of costs was taxed in his absence and he said such was unconstitutional.
