STD BANK REPORTS BOYCEY TO LAWYERS FOR DEFAMATION

MBABANE – Standard Bank Swaziland has reported Boycey Magongo to its lawyers after he made serious allegations against the banking institution and its staff.


According to a hand-delivered letter of demand from the banking institution’s lawyers, Robinson Bertram, Magongo allegedly made a series of allegations against the bank on social networking site Facebook.


“Our client has instructed us that you have made a series of unwarranted and defamatory attacks (posts) against it on their Group Facebook page wherein you, among other things, accused our client,” reads, in part, the letter of demand.
There are four allegations listed in the letter of demand which cannot be repeated given their sensitive nature. The law firm further stated that it had been informed that Magongo had made serious allegations against the bank’s top management. In the letter of demand, the lawyers further stated that they had seen the posts by Magongo on Facebook.


It further dismisses the allegations made in reference to the banking institution as utterly false.

“The statements made in reference to our client are utterly false, without merit and they are defamatory in that they depict our client as engaging in criminal activity,” the law firm said.
Robinson Bertram further stated that the bank had been in business in the country for over 40 years. In these years, according to the law firm, the bank had provided customers with banking facilities and provided a high level of customer services.


“Our client has established a well-founded reputation for the quality of its customer satisfaction and your unwarranted actions and baseless accusations have damaged that reputation and adversely affected our client’s business since the Group Facebook page is read by customers and potential customers worldwide. Our client reserves its rights thereof.”


The law firm further stated that it had been duly informed that Magongo was no longer a customer of the bank as he had closed his account on October 30, 2012. This, they stated, substantiated that the bank only assisted customers who banked with it and those who were not clients of the bank may not be assisted with any banking facilities that they may require.


“Our client fails to understand your insistence on getting a service notwithstanding that you are not a customer for it,” the law firm said.
It is further alleged that the bank’s management and human resource had repeatedly advised Magongo that he could not be assisted as he was not a customer of the bank.


Magongo is said to have continuously refused to accept the reasons advanced to him. The bank instructed Magongo, through Robinson Bertram, that he should immediately cease, or desist and or refrain from posting any information about the bank on his Facebook page or any other similar social media platforms.
